AKIN Travel Pty Ltd (ABN 43 686 493 201) (AKIN, we, us or our) offers a program in which users may accrue loyalty points and benefits when they book overnight accommodation with selected operators of boutique hotels and hostels globally (AKIN Travel Loyalty Program).
AKIN co-operates with the operators of hotel and hostel properties (Partner, you, your) to deliver the AKIN Travel Loyalty Program. These terms and conditions (Terms) govern the arrangement between us and each Partner. You agree to be bound by these Terms, as updated from time to time.
These Terms continue from the date of acceptance, until terminated in accordance with the termination provisions set out below at condition 15.
AKIN also operates a booking engine, integrated within the AKIN Platform, through which Members may search for, book and pay for Stays with Partners directly. Bookings and payments made in this way are governed by condition 5 (Bookings and Payment), in addition to these Terms generally.
Participation in the AKIN Travel Loyalty Program is subject to customer terms and conditions (https://akintravel.com/en/terms) (Program Terms). AKIN will manage the AKIN Travel Loyalty Program in accordance with those Member Terms (which are subject to change from time to time).
Upon registering as a member of the AKIN Travel Loyalty Program (Member), each Member is allocated a unique membership identification number / code (Membership Number) as an identifier linked to their account in the AKIN Travel Loyalty Program (Member Account).
When Members book a stay with a Partner through the AKIN website (https://akintravel.com/) (AKIN Platform) or directly through a Partner, they will be entitled to accrue non-transferrable loyalty points (AKIN Points).
We allocate Members to a level of membership (Membership Tier) based on the number of AKIN Points held, the number of Origin and Network Stays, and other partner-specific rules. Members accrue AKIN Points in accordance with the level of membership reached:

For the purposes of these Terms:
Membership Tiers are determined based on the number of AKIN Points the Member earns, the number of Origin and Network Stays, and other partner-specific rules, during the 12 month period commencing on the date that the Member successfully registers to become a Member (Membership Year).
AKIN Points do not expire during a Membership Year. Members can move up in Membership Tiers at any time during a Membership Year. Members will not be moved down a Membership Tier during a Membership Year. They will only be moved down a Membership Tier on or about the anniversary of the commencement of their Member Account.
Where you have facilitated the initial registration of an AKIN Travel Loyalty Program Member in a verifiable way (including but not limited to through links and/or QR codes on your website, social media accounts or on-property advertising), we will designate you as the Origin Partner for that Member. You may advise us if you consider that you have not been designated as the Origin Partner for a Member you have introduced to the AKIN Travel Loyalty Program. Our designation of the Origin Partner for a Member is final and binding (in the absence of manifest error).
We reserve the right to update the eligibility requirements and AKIN Points mechanics for each Membership Tier, from time to time. This does not affect your right under condition 4.2 to determine, in your absolute discretion, the AKIN Benefits you offer to Members.
For each Stay by a Member at a Partner property, Members will accrue:
Where Members book a Stay with a Partner at a Partner Property:
You must verify the proof of membership of any Member prior to providing any AKIN Benefits to that Member. We will not be responsible for any AKIN Benefits provided to a Member if you do not validate the Member’s Account details. Where a single Platform Booking covers more than one bed, room or guest, the Member who made the Platform Booking is entitled to AKIN Benefits and is treated as having earned AKIN Points for the Platform Booking as a whole, but may only claim Stay credit for one Stay under these Terms, unless and until a specific bed, room or element of the Platform Booking is allocated to another AKIN Member who is participating in the stay using the allocation feature on the AKIN Platform (identifying that Member by name and AKIN Membership Number). Where an element of a Platform Booking is allocated in this way, the Stay credit (only) is also attributed to the specified AKIN Member, and the AKIN Member is entitled to on-property AKIN Benefits as if the booking was in their own name, based on their prevailing membership tier. The AKIN Points, Origin partner attribution and Travel Credit are not reallocated.
When a Member completes a Stay or cancels or reschedules a Stay with you, you are responsible for ensuring your PMS system is updated accordingly. You must ensure that rate plans for your Partner Property are named and described clearly and accurately in your PMS (including whether a rate is flexible/refundable or non-refundable), as AKIN determines how the Deposit is treated on a cancellation, amendment or no-show for a Platform Booking under condition 5.6, by reference to that information. AKIN’s determination of how the Deposit is treated under condition 5.6 from that information is for the purposes of condition 5.6 only, is not a substitute for, and does not override, the Partner’s own published cancellation policy for the Balance, and AKIN is not liable for any inaccuracy in that determination arising from the Partner’s own rate-plan naming or description.
You must notify us if you no longer operate a Partner Property or make other changes to the Partner Property that would impact on the operation of the AKIN Travel Loyalty Program.
Members are entitled to receive a discount, free gift or other benefit (AKIN Benefit) when Members book a Stay at your Partner Property. You agree to offer an AKIN Benefit to each Member that books a Stay with you. The AKIN Benefit may be determined based on the Membership Tier of the relevant Member (ie those Members who are on higher Membership Tiers may receive a greater AKIN Benefit).
You determine the AKIN Benefits that you offer to Members in your absolute discretion. AKIN Benefits may include, for example, a free drink on arrival for the Stay, free wifi during the Stay or a discount on food/ drink or experiences offered by the Partner.
If you operate multiple Partner Properties that are available as part of the AKIN Travel Loyalty Program, the AKIN Benefits can differ across the various properties.
You must notify us of the AKIN Benefits that you will offer to Members from time to time by selecting them for each Partner Property that you manage that is listed on the AKIN Platform. If you decide to alter the AKIN Benefits available at a Partner Property, you must update the list on the AKIN Platform.
You must provide the AKIN Benefits to Members who complete their Stay at your Partner Property.
We are not responsible for and will not be liable for any redemption of AKIN Benefits, or your failure to honour an AKIN Benefit. To the maximum extent permitted by applicable law, we exclude all liability arising in connection with any act or omission by you in connection with redemption of AKIN Benefits under the AKIN Travel Loyalty Program.
AKIN Benefits can only be redeemed by a Member during the relevant Stay. If the AKIN Benefit is not requested or received during the duration of the Stay, the Member will forgo that AKIN Benefit.
AKIN Benefits are only made available to Members. AKIN Benefits are personal to each Member and cannot be transferred.
You are responsible for monitoring bookings at your Partner Property and providing AKIN Benefits to Members during their Stay with you. To allow you to do this, there are two main lines of communication:
You enter into a separate contract with the Member when you agree to provide an AKIN Benefit to the Member.
Members may search for, book and pay for a Stay with the Partner directly through the booking engine integrated within the AKIN Platform (Booking Engine), in addition to booking directly with the Partner.
Where a Member books and pays for a Stay through the Booking Engine (Platform Booking), the total price payable by the Member for the Stay (Total Booking Value) is comprised of:
AKIN collects the Deposit using a PCI-DSS compliant third party payment processor. AKIN does not store the Member’s full payment card details.
The Deposit is retained by AKIN in full as AKIN’s commission for operating the Booking Engine (Commission). Where a Platform Booking completes and the Partner for that Platform Booking is not also the Member’s Origin Partner, AKIN retains 10% of the Net Booking Value as its own Commission, pays 2.5% of the Net Booking Value to the Member’s Origin Partner as a trailing commission (Trailing Commission), and credits the remaining 2.5% of the Net Booking Value to the Member as Travel Credit. Where the Partner for the Platform Booking is also the Member’s Origin Partner, AKIN does not retain any part of the Deposit as Commission; instead AKIN pays 12.5% of the Net Booking Value to the Partner as Trailing Commission and credits the remaining 2.5% of the Net Booking Value to the Member as Travel Credit. Subject to that Trailing Commission and Travel Credit, the Partner has no further entitlement to any part of the Deposit. Where a Deposit for a Platform Booking is paid, in whole or in part, using Travel Credit, that Deposit is treated in the same way as a Deposit paid by any other means for the purposes of this condition 5, including AKIN’s Commission, the Origin Partner’s Trailing Commission, and the Member’s further entitlement to Travel Credit under this condition 5.4.
The Deposit is non-refundable to the Member once a Platform Booking is confirmed, regardless of cancellation, amendment, no-show or change of mind by the Member, except:
If a Member cancels, amends or does not show for a Platform Booking in circumstances other than condition 5.5(1) or (2) above: (1) where the Platform Booking was made under a rate identified as non-refundable, the Deposit is retained and distributed in the same way as for a completed Platform Booking under condition 5.4; or (2) where the Platform Booking was made under a rate identified as flexible or refundable, AKIN will not retain any part of the Deposit as Commission - AKIN will instead credit 15% of the Net Booking Value to the Member as Travel Credit.
The Origin Partner’s entitlement to Trailing Commission under condition 5.4 arises only once a Platform Booking completes, or is cancelled, amended or does not show in circumstances where the Deposit is retained under condition 5.6(1) (in which case Trailing Commission arises in the same way as for a completed Platform Booking under condition 5.4), whether or not the Origin Partner is also the Partner for the relevant Platform Booking. Despite the foregoing, no Trailing Commission arises at the time of a cancellation, amendment or no-show to which condition 5.6(2) applies, because no part of the Deposit is retained by AKIN or paid to the Origin Partner at that time under condition 5.6(2). Where the Travel Credit issued to the Member under condition 5.6(2) is later applied, in whole or in part, towards the Deposit for a further Platform Booking, Commission, Trailing Commission and any further Travel Credit arise in respect of that further Platform Booking in the ordinary way under condition 5.4, including because that Deposit is treated the same as a Deposit paid by any other means under condition 5.4. Despite condition 5.4, no Trailing Commission is payable to a Partner in respect of a Platform Booking that completes, or is cancelled, amended or does not show in circumstances where condition 5.6(1) applies, on or after the date that Partner exits or is removed from the AKIN Travel Loyalty Program, even if that Partner was the Member’s Origin Partner immediately before that date. In those circumstances, AKIN retains as additional Commission the percentage of the Net Booking Value that would otherwise have been payable to the Partner as Trailing Commission under condition 5.4.
Where the Deposit includes Partner-related costs under condition 5.2(1), the Member is only required to bear those costs to the extent they have actually been incurred in connection with the Stay as at the date of cancellation, amendment or no-show; any such costs not actually incurred will not be deducted and will instead be available to be credited to the Member as Travel Credit under this condition 5.6.
The Partner is solely responsible for:
AKIN has no liability to the Partner, and the Partner has no claim against AKIN, for any failure by a Member to pay the Balance, or for any dispute between the Partner and a Member regarding the Balance.
If a Member cancels, amends or does not show for a Platform Booking, the Partner is not entitled to receive any part of the Commission, irrespective of the Partner’s own payment or cancellation terms applicable to the Balance. This does not affect the Origin Partner’s entitlement to its trailing commission under condition 5.4, which is determined in accordance with, and subject to the exception in, condition 5.7.
This condition 5 does not apply where a Member books directly with the Partner outside the Booking Engine. In that case, the Member deals with the Partner directly in respect of payment for the Stay.
The Partner must ensure that at all times while it is a Partner in the AKIN Travel Loyalty Program, that it:
In consideration for your participation in the AKIN Travel Loyalty Program, AKIN Travel may from time to time, provide the following benefits to Partners who are part of the AKIN Travel Loyalty Program:
The benefits available to Partners may vary from time to time. We will notify you in advance of any changes to the benefits available to you through the Partner Portal.
You acknowledge and agree that we feature Partner Properties on the AKIN Platform and in our advertising and Member communications based on our understanding of our Members’ likely interests. We do not accept paid advertising or other benefits in return for the promotion of any Partner Property. Where AKIN uses automated or artificial intelligence-based tools to rank or personalise the display of Partner Properties to Members (for example, based on a Member’s stated preferences, or search or booking history), that ranking does not affect the Commission payable by the Partner and cannot be purchased or otherwise influenced by payment from the Partner.
In addition to using the Partner Portal and/or PMS to confirm whether a customer is a Member with AKIN Benefit entitlements, you are expected to use these platforms to customise each Member’s experience. For example, when greeting a customer at check-in, you are expected to personalise their greeting and acknowledge their status as a Member.
You must not use the personal information and Member Account details to market to or promote your goods or services to Members unless those Members have separately consented to share their personal information with you, in accordance with your own privacy policy and terms of use. Any use of Member information in a way that is not expressly in accordance with these Terms, the Member Terms and our Privacy Policy will constitute a material breach of these Terms, entitling AKIN Travel to immediately terminate your participation in the AKIN Travel Loyalty Program.
Any Member complaints or concerns raised with you in relation to your obligations in the AKIN Travel Loyalty Program should be dealt with promptly by you.
You are responsible for reviewing and responding to Member complaints regarding the redemption of (or non-supply of) any AKIN Benefits. If a complaint is sent directly to us, we will redirect the complaint to you. If we request further information in relation to the complaint or claim made by a Member, you must provide us with all information that we request in relation to the complaint or claim.
We will give you the first opportunity to handle or remedy any Member complaint or claim. Without prejudice to any rights we may have against you, we may, but are not obliged to, take action to remedy any complaint or claim received from a Member if you do not satisfactorily resolve the issue within a reasonable period of time.
If we take action or incur expense in order to remedy a complaint or claim arising from your breach of these Terms or the Member Terms, we may on demand, recover that expense from you, together with our costs of taking action to remedy the issue.
No fees or charges are payable for participation as a Partner in the AKIN Travel Loyalty Program, except for the Commission payable to AKIN on each Platform Booking in accordance with condition 5 (Bookings and Payment).
No fees or charges are payable by us in consideration for the provision of AKIN Benefits to Members. Any such costs or expenses will be borne solely by you.
AKIN may vary the rate of Commission from time to time by giving the Partner at least 30 days’ written notice via the Partner Portal. Continued participation in the AKIN Travel Loyalty Program, and continued use of the Booking Engine, after that notice period takes effect will constitute your acceptance of the revised Commission rate. For the purposes of this condition 10.3, a change to the rate of Commission includes any change to how the Deposit is distributed between AKIN, the Origin Partner and the Member under condition 5.4.
AKIN pays each Partner any Trailing Commission owing to that Partner monthly, in USD, together with a reconciliation statement setting out the Platform Bookings to which that payment relates. A Partner remains entitled to be paid any Trailing Commission that has accrued as at the date the Partner exits the AKIN Travel Loyalty Program or becomes insolvent, even though that amount may not yet have been paid as at that date. A Partner is not entitled to any Trailing Commission accruing on or after the date it exits or is removed from the AKIN Travel Loyalty Program, in accordance with condition 5.7.
Our privacy policy is available at https://akintravel.com/en/privacy (Privacy Policy). We may vary our Privacy Policy from time to time. If we vary our Privacy Policy and the variation will impact you or the way that you are required to treat personal information in connection with the AKIN Travel Loyalty Program, we will provide you with reasonable notice in advance of the introduction of the revised Privacy Policy.
You agree that it is a condition of being a Partner that you:
You must give all necessary notices and obtain all necessary consents when collecting, using and sharing personal information about a Member when you create a Member Account for a new Member for which you are the Origin Partner, or if you otherwise collect any personal information relating to the Member in connection with the AKIN Travel Loyalty Program.
For the purposes of this condition 11:
If you become aware of, or reasonably suspect, that a Data Breach has occurred, then you must:
You must ensure that your systems are secured and you have implemented reasonable and appropriate processes to prevent unauthorised access to personal information relating to any Member, including Member Accounts.
From time to time, we may make data and insights available to you from the personal information and Member data that we have collected in the AKIN Travel Loyalty Program. This data and any insights will be based on de-identified information from Members and the AKIN Travel Loyalty Program. You must not reverse engineer or use any such data (whether by itself or in combination with any other data sources) in order to identify any individuals.
You acknowledge that, by virtue of these Terms, you may receive or become aware of a Member’s personal information as well as data and information relating to AKIN, the AKIN business and the AKIN Travel Loyalty Program (Confidential Information). You agree to only use Confidential Information in relation to the administration of the AKIN Travel Loyalty Program and must not disclose any Confidential Information to any person other than to your officers, employees, agents or contractors to the extent it is necessary for the fulfilment of your obligations under these Terms.
This clause does not apply to any information in relation to the AKIN Travel Loyalty Program or its Members which is generally available to the public (other than as a result of wrongful disclosure by you) or is required to be disclosed by any applicable law.
You acknowledge that all Intellectual Property Rights in the AKIN Travel Loyalty Program belong or have been licensed to AKIN and you do not by virtue of these Terms obtain any interest in those Intellectual Property Rights. You agree to not make any claim for ownership of any Intellectual Property Rights in the AKIN Travel Loyalty Program.
You must not use any of AKIN’s Intellectual Property Rights unless authorised by us in writing. For more information on authorised uses of AKIN’s Intellectual Property Rights, please refer to the brand guidelines available on the Partner Portal (https://akintravel.com/en/partner).
You grant us a royalty free, non-exclusive licence to use your Intellectual Property Rights (including but not limited to your trade marks, business name and images and content that you share with us) solely for the purpose of promoting and administering the AKIN Travel Loyalty Program. Upon the termination of these Terms, this licence terminates.
In the event you provide us with commentary or a review of your involvement in the AKIN Travel Loyalty Program, you grant to us a royalty free, non-exclusive and non-revocable licence to use and publish your comments solely for the purpose of promoting and administering the AKIN Travel Loyalty Program.
In these Terms, Intellectual Property Rights includes any:
The Partner must take out and maintain at all times while it is a Partner in the AKIN Travel Loyalty Program, the following insurances:
in each case for amounts and on terms that a prudent supplier of travel, leisure and accommodation services would take out. The Partner must provide certificates of currency for such insurance policies to AKIN Travel, promptly on request to do so.
Either party may terminate these Terms with immediate effect if:
AKIN may terminate the Partner arrangement:
You may terminate the Partner arrangement without cause at any time by giving AKIN no less than 30 days’ written notice of your intention to terminate. You acknowledge that the 30-day notice period is reasonably required to ensure AKIN has time to update Members in advance of booked Stays.
Each party must continue to comply with its obligations under these Terms during any notice period prior to termination taking effect.
On termination of these Terms and the Partner’s participation in the AKIN Travel Loyalty Program:
In this condition 15, an Insolvency Event is the occurrence of any of the following events in respect of a party: (a) a person is, or is stated to be, unable to pay its debts as and when they fall due; (b) an administrator, liquidator, controller, receiver, receiver and manager, trustee, or similar officer is appointed to it or any of its assets; (c) an application is made, or an order is passed, for its winding up, dissolution or deregistration; (d) it enters into, or resolves to enter into, any arrangement, compromise or composition with its creditors; or (e) anything occurs under any applicable law that has substantially similar effect to any of the events described above.
Each of the parties represents and warrants to the other that it has the full power, authority and right to enter into these Terms and perform its obligations under these Terms.
To the maximum extent permitted by law, we make no representations or warranties to you, express or implied, regarding any matter except for those expressly set out in these Terms. We give no warranty as to the ongoing availability of the AKIN Travel Loyalty Program or the volume of enquiries or bookings you will receive from Members of the AKIN Travel Loyalty Program.
You represent and warrant to us that:
To the maximum extent permitted by applicable laws, AKIN Travel’s liability to the Partner for a breach of these Terms is limited to re-performing the relevant obligations or re-supplying relevant services correctly.
AKIN Travel will not be liable to the Partner for any loss, harm, damage, cost or expense (including legal fees) in the nature of special, indirect or consequential loss or damage. This includes, without limitation, economic loss, loss of contract, loss of profit or revenue or loss of opportunity.
Each party (Indemnifying Party) agrees at all times to indemnify the other party (Indemnified Party) against all damages, losses, liabilities, claims or actions which may be brought against the Indemnified Party arising directly from:
The liability of the Indemnifying Party will be reduced proportionately to the extent that the Indemnified Party caused or contributed to the loss or damage.
Each party must use its best endeavours to mitigate any loss or damage that it causes to the other party or any third party.
Both parties agree to give the other party a reasonable opportunity to consider, respond to and resolve any complaint or dispute related to these Terms before initiating legal proceedings, other than legal proceedings for urgent or injunctive relief.
If any provision of these Terms is held to be unenforceable, the provision shall be read down only to the extent necessary to make it enforceable. If the provision is unable to be read down, it is severed from the remainder of the Terms without affecting the validity or enforceability of the remaining provisions of these Terms, which remain in full force and effect.
A failure by us to assert or enforce any right under these Terms does not constitute a waiver of that right, nor will any such failure be taken to be a further or continuing waiver of that term or right.
We may assign, novate, subcontract or otherwise transfer or deal with any of our rights and obligations under these Terms to a third party. We will notify you of the transfer within 30 days of the transfer occurring. If you reasonably consider that the assignment, novation or transfer causes you material detriment, you may terminate the Partner arrangement in accordance with condition 15.3. Any assignee will be subject to these Terms as if all references to AKIN or us were references to the assignee.
You must not at any time assign, novate, subcontract or otherwise transfer all or any part of your rights and obligations under these Terms to a third party without our prior written consent (which will not be unreasonably withheld).
We may revise these Terms from time to time, and the revised version will be effective on the date we specify. We will notify you of changes to these Terms.
If our changes to the Terms reduce your rights or increase your responsibilities, we will provide you with at least 30 days’ notice of the changes. If you are not satisfied with the proposed Terms, you may terminate these Terms and your participation in the AKIN Travel Loyalty Program in accordance with condition 15.3.
Obligations contained in these Terms will be suspended for the duration of any Force Majeure Event to the extent that the relevant party is prevented by the Force Majeure Event from performing its obligations. The parties must each use their reasonable endeavours to reduce the impact of any Force Majeure Event.
In these Terms, a Force Majeure Event means any of the following events:
These Terms (and any policies referred to or incorporated into the Terms), the Member Terms and our Privacy Policy constitute the entire agreement between you and AKIN relating to the AKIN Travel Loyalty Program (and supersede all other prior written agreements on the subject matter between the parties).
Nothing in these Terms evidences a partnership, agency, joint venture or relationship of employer and employee. The parties are independent contractors. The Partner has no authority to bind AKIN.
AKIN may, in its discretion, offer selected Partner groups or chains the ability to operate a co-branded or white-label version of the AKIN Travel Loyalty Program (White-label Program) under separate commercial terms agreed with AKIN.
Where the Partner participates in a White-label Program, these Terms continue to apply in addition to the separate terms agreed for that White-label Program. In the event of any inconsistency, the White-label Program terms prevail to the extent of the inconsistency.
Nothing in this condition obliges AKIN to offer, or the Partner to accept, participation in a White-label Program.
These Terms are governed by and will be construed in accordance with the laws of the State of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales and of the Commonwealth of Australia.
